Terms of Service

These Terms of Service ("Terms") govern your access to and use of OpenOut (the "Service"), operated by Tim Geithner ("we", "us", "OpenOut"). Our full operator details are on the Imprint page. By creating an account or using the Service you agree to these Terms. If you don't agree, please don't use the Service.
These Terms are provided in English. Where we supply a translation, the English version prevails in case of conflict. Mandatory statutory rights you have as a consumer under the law of your country of residence are unaffected by anything in these Terms.
1. What OpenOut does
OpenOut is a link-in-bio and deep-link platform. You build a public page under an OpenOut handle, add links and content blocks, and share it. Our breakout routing engine additionally detects in-app browsers — such as those inside TikTok or Instagram — and tries to hand visitors off to their normal system browser. Details and limits of that feature are in §8.
We provide software and hosting. We are not a party to any transaction, agreement or relationship between you and the visitors of your page, nor between you and any third party you link to.
2. Your account
You're responsible for the activity on your account and for keeping your credentials secure. You must provide accurate information when signing up and promptly update it if it changes. You must be at least 16 years old to use OpenOut. If you register on behalf of a company or another person, you confirm you're authorized to accept these Terms for them.
One person or entity may not maintain multiple free accounts to circumvent plan limits. Tell us at TGEcom@email.de promptly if you suspect unauthorized access to your account.
3. Handles
Handles (the openout.app/yourname part of your page URL) are assigned on a first-come basis and remain our property. Some handles are reserved for system routes and brand protection. We may reclaim or change a handle if it infringes someone's trademark or other rights, impersonates a person or organization, is used for abuse, or is squatted without genuine use — where feasible, with prior notice and an opportunity to respond.
4. Acceptable use
You agree not to use OpenOut to:
- Host, distribute or link to illegal content, malware, phishing or deceptive download pages
- Impersonate another person, brand or organization, or misrepresent an affiliation
- Publish content that infringes copyright, trademark, personality or other third-party rights
- Publish content that is harassing, hateful, violent, or sexually exploitative, or that is harmful to minors
- Run scams or misleading offers — including fake giveaways, "guaranteed returns" investment or crypto schemes, and undisclosed paid promotion
- Circumvent platform rate limits or security controls, scrape the Service, or abuse the breakout routing engine to redirect visitors to a destination other than the one they were shown
- Send spam, or collect newsletter sign-ups or other personal data without a legal basis and a valid privacy notice
- Resell, sublicense or white-label the Service as your own product without a written agreement with us
You're also responsible for complying with the rules of the platforms you share your OpenOut link on, and for legally required labelling of advertising, sponsorships and affiliate links on your page.
We may remove content, restrict features, or suspend or terminate accounts that violate these Terms. Where we take such action we inform you of the reason and you can object by replying to that notice or by writing to TGEcom@email.de; we review objections and restore access if the report turns out to be unfounded.
5. Plans, billing and cancellation
Free plan features are provided at no cost, subject to the limits shown on our pricing page. Paid plans (Pro at $9/month, Agency at $19/month, annual pricing where offered) are billed in advance through our payment processor, Stripe. The plan, price and billing interval shown to you at checkout are the binding ones; the contract is concluded when checkout succeeds. Subscriptions renew automatically for the same interval until cancelled.
Prices are shown in US dollars. We currently operate as a small business under §19 UStG (Kleinunternehmerregelung) and therefore do not charge German VAT; where tax is nevertheless due in your jurisdiction, Stripe calculates and adds it at checkout based on your billing address, and the total payable is the one displayed there.
You can cancel anytime from your dashboard's billing settings. Cancellation takes effect at the end of the current billing period — you keep paid features until then and we don't refund partial periods except where required by law. If a payment fails, we may retry it and restrict paid features until the invoice is settled. Downgrading may reduce your limits (for example the number of pages or links you can keep published); content over the new limit stays stored but may be unpublished until you're within the limit again.
Free trial. First-time subscribers to a paid plan may receive a free trial of up to 7 days, as shown at checkout. Eligibility is limited to accounts that have never held a paid subscription before — resubscribing after a cancellation does not grant a second trial. Unless you cancel before the trial ends, it automatically converts into a paid subscription and your payment method is charged at the plan's regular price. You can cancel during the trial from your dashboard's billing settings at no charge.
We may change prices or plan limits for future billing periods. We'll tell you at least 30 days in advance by email or in the app; if you don't accept the change you can cancel before it takes effect.
6. Right of withdrawal (consumers in the EU/EEA)
If you're a consumer residing in the EU/EEA, you have the right to withdraw from a paid subscription within 14 days of entering into it, without giving any reason.
Withdrawal instruction. The withdrawal period is 14 days from the day the contract was concluded. To exercise the right of withdrawal, you must inform us — see the operator details on our Imprint page, or email TGEcom@email.de — by a clear statement of your decision to withdraw from this contract. You may use the model withdrawal form below, but it is not obligatory. To meet the deadline it is sufficient for you to send your communication before the withdrawal period expires. If you withdraw, we will reimburse all payments received from you without undue delay and no later than 14 days after we are informed, using the same means of payment you used, at no fee to you.
Model withdrawal form. "To OpenOut (operator details as stated in the Imprint): I/we hereby give notice that I/we withdraw from my/our contract for the provision of the following service: OpenOut subscription. No early expiry. We do not ask you to waive your right of withdrawal, and checkout never asks you to request that we begin performance before the period ends. Your 14 days therefore run in full, even if you use the Service in the meantime.
7. Your content
You retain ownership of the pages, links and media you create with OpenOut. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt (for technical formats and sizes) and display that content solely to operate, secure and support the Service. The license ends when you delete the content or your account, except for backups and logs that expire on their normal schedule.
You're responsible for having the rights to any content you upload or link to, and for the accuracy and legality of your page. We don't systematically monitor user content, but we may review and remove content when we're made aware of a possible violation.
We may display a discreet "Made with OpenOut" badge on free-plan pages. Paid plans can turn it off. Our own trademarks, logos and the Service's software remain ours; these Terms grant you no rights in them beyond using the Service as intended.
8. Reporting illegal content
Anyone can report a public OpenOut page using the report link in its footer, or by writing to TGEcom@email.de. Please describe the content, its URL, and why you believe it is unlawful or violates §4, and include contact details so we can reach you. We review reports, act where a violation is found (removing content, restricting or suspending the account), and inform the reporter and the affected user of the outcome and the reasons. Misuse of the reporting mechanism through repeated manifestly unfounded reports may lead to us suspending processing of that person's reports.
9. The breakout engine
OpenOut's breakout routing detects in-app browsers and attempts to hand visitors off to their default browser. Whether an automatic hand-off is possible depends on the visitor's platform, app and OS version and is not guaranteed on any specific device — where it isn't available, we surface manual instructions and a copy-link fallback. Platforms change their in-app browsers without notice, so detection and success rates change over time. We don't guarantee a specific conversion, click-through or hand-off rate, and breakout behaviour is not a promised feature characteristic of any plan beyond access to the feature itself.
10. Analytics data
The Service records aggregated, privacy-friendly statistics about visits, clicks and breakout events on your pages, and makes them available in your dashboard subject to your plan's retention window. When that window passes, older event data is deleted and cannot be restored. If you use analytics data about your visitors, you are the controller of that use and responsible for your own privacy notice; see our Privacy Policy for how we process personal data.
11. Third-party services
The Service relies on third parties — including our hosting and database infrastructure, Stripe for payments, and our email delivery provider. Their availability affects ours. Any third-party service, platform or website you connect or link to is governed by that provider's own terms, and we are not responsible for it.
12. Availability and changes
We aim to keep OpenOut reliable but don't guarantee uninterrupted availability; maintenance, incidents and third-party outages happen. No specific uptime level is agreed unless we've confirmed one in writing. We may change, add or discontinue features; for changes that materially reduce what a paid plan offers, we'll give reasonable advance notice and you may cancel.
13. Termination
You may stop using the Service and delete your account at any time from your account settings. Deleting your account unpublishes your pages and deletes your data as described in the Privacy Policy; handles may be released for reuse. We may suspend or terminate access for Terms violations, non-payment, or to protect the Service, other users or third parties, and — for serious or repeated violations — without prior notice. Statutory rights to terminate for cause remain unaffected on both sides.
14. Liability
The Service is provided "as is." To the maximum extent permitted by law, we aren't liable for indirect, incidental, or consequential damages, lost profits, lost reach, or lost data arising from your use of OpenOut.
Nothing in these Terms excludes or limits liability for intent or gross negligence, for injury to life, body or health, for the absence of a guaranteed characteristic, or any liability under mandatory consumer-protection or product-liability law. For slight negligence we are liable only for breach of a material contractual obligation, and limited to the foreseeable damage typical for this kind of contract.
You'll keep us harmless from third-party claims arising from content you publish through the Service or from your breach of these Terms, unless you're not responsible for the underlying cause.
15. Changes to these Terms
We may update these Terms from time to time. We'll announce material changes at least 30 days in advance by email or in the app. If you don't agree with a change, you can cancel your account or subscription before it takes effect; continuing to use the Service after that date means you accept the updated Terms.
16. Governing law and jurisdiction
These Terms are governed by, and the courts of, Hamburg, Germany — German law applies. This doesn't affect the right of consumers to bring proceedings before the courts of their own country of residence, and mandatory consumer-protection laws of your country of residence remain unaffected.
17. Final provisions
If a provision of these Terms is or becomes invalid, the remaining provisions stay in force. You may not transfer your rights under these Terms without our consent; we may transfer ours to a successor in connection with a merger, acquisition or sale of assets, with notice to you. Our failure to enforce a provision isn't a waiver of it. Together with the Privacy Policy and the plan details shown at checkout, these Terms are the entire agreement between us for the Service.
